Terms and Conditions

These Terms govern the use of this Application and any other related Agreement or legal relationship with the Owner, in a legally binding way. Capitalised words are defined in the section at the end of this document.

Please read this document carefully.


Introduction and acceptance

These Terms of Use (“Terms”) govern access to and use of the WIA Community e.U. platform (“Where I’m At Community”) and related services. By accessing, registering, or using any part of the website or platform, you accept and agree to be bound by these Terms. If you do not agree, do not register or use our services.

The structure and availability of the platform, including whether any areas are free or subject to a charge, may change in future. Where material changes affect your access, you will be notified in advance and given the opportunity to decide whether to continue.

A note on the sale terms in this document. Where I’m At Community is currently free to join and use. The Terms and Conditions of Sale set out below apply only where WIA Community e.U. makes specific paid products, standalone courses, or digital goods available for separate purchase. They do not apply to basic platform membership, which is provided free of charge.

“This Application” refers to:

  • this website, including its subdomains and any other website through which the Owner makes its Service available
  • applications for mobile, tablet and other smart device systems
  • the Service

The Service is intended only for Consumers.

What Where I’m At Community is

Where I’m At Community is a private online community and learning space that provides peer support and educational content for working professionals affected by burnout and chronic stress, and for those navigating recovery and the process of reconnecting with themselves in a healthier and more sustainable way.

The Service is built around the Where I’m At framework:

  • RECOGNISE: noticing where you are with honesty, awareness, and reflection
  • RESET: creating gentler rhythms, steadier foundations, and supportive daily practices
  • REINVENT: exploring what comes next for work and life through practical tools, resources, guided pathways, and trusted next-step options

The REINVENT area may include orientation tools, practical work-life resources, self-guided pathways, educational materials, and curated partner or referral content. What is available may evolve over time.

Services may include community discussion spaces, resource libraries, self-guided materials, group sessions, workshops, live or recorded events, digital tools, and educational resources.

What we provide

  • A moderated online community for peer connection and mutual support
  • Educational resources based on lived experience, research-informed practices, and guest contributions
  • Group-based sessions and community events focused on learning, reflection, and shared experience
  • Optional prompts, templates, and tools to help members reflect and explore next steps at their own pace

Participation is voluntary. Members choose how they engage, including reading only (“lurking”), posting, attending events, or using the resources.

What we do not provide

Where I’m At Community does not provide:

  • Psychotherapy, counselling, clinical psychology, medical treatment, or crisis services
  • Diagnosis, assessment, or treatment of mental health conditions
  • Individual coaching or personalised one-to-one support plans
  • Medical, legal, financial, HR, or employment advice

Any examples, suggestions, or tools shared in the community are provided for general educational purposes and are not a substitute for professional advice tailored to an individual situation.

Member responsibility and professional support

Members are responsible for their own decisions, actions, and wellbeing. If you are experiencing severe distress, symptoms that feel unmanageable, or you are concerned about your safety, you should seek professional support from a qualified healthcare provider.

If you are in immediate danger or at risk of harming yourself or others, contact emergency services immediately.

Community boundaries and peer sharing

Members may share personal experiences, coping strategies, and what has helped them. Community content should be understood as peer sharing (“what helped me”) rather than instructions or professional guidance.

We aim to maintain a respectful and supportive environment through moderation and community guidelines, including consent-before-advice, confidentiality expectations, and restrictions on harmful or inappropriate content.

Changes to the service

We may update, add, remove, or modify community features, resources, or events over time. We will aim to communicate significant changes in the community hub or by email where appropriate.


Eligibility and age verification

Only persons aged 18 years or older may register and use our platform. Age is verified by self-declaration during account creation. Accounts found to have false declarations will be terminated and associated data deleted in line with legal obligations.


Account registration

To use the Service, Users must register or create a User account, providing all required data or information in a complete and truthful manner. Failure to do so will cause unavailability of the Service.

Users are responsible for keeping their login credentials confidential and safe. For this reason, Users are also required to choose passwords that meet the highest standards of strength permitted by this Application.

By registering, Users agree to be fully responsible for all activities that occur under their username and password.

Users are required to immediately and unambiguously inform the Owner, via the contact details indicated in this document, if they think their personal information, including but not limited to User accounts, access credentials or personal data, has been violated, unduly disclosed or stolen.

Account termination

Users can terminate their account and stop using the Service at any time, by using the tools provided for account termination on this Application.

Account suspension and deletion

The Owner reserves the right, at its sole discretion, to suspend or delete at any time and without notice, User accounts that it deems inappropriate, offensive or in violation of these Terms.

The suspension or deletion of User accounts shall not entitle Users to any claims for compensation, damages or reimbursement.

The Owner reserves the right to suspend, restrict, or delete User accounts where reasonably necessary to enforce these Terms, comply with applicable law, protect Users, or maintain the safety, integrity, and functioning of the Service. Where appropriate, notice may be given, but immediate action may be taken in more serious situations.


Access and licensing

Opening period access

Where I’m At Community is currently free to join and use. This is a genuine opening offer, not a trial. There is no automatic conversion to a paid arrangement.

WIA Community e.U. reserves the right to change how access is structured in the future. If changes are made that affect your access or introduce charges, you will receive advance notice by email and/or platform announcement before they take effect. You will not be charged without taking an explicit action to agree.

Membership access

Once registered, you may use the community spaces, resources, and features made available to members at the time of your use. Included content and features may change as the platform develops. Significant changes will be communicated via the platform hub or by email.

Member-included content may include:

  • RECOGNISE
  • RESET
  • REINVENT Checkpoint
  • REINVENT Worklife Foundations
  • Selected REINVENT Partners content
  • Other member materials made available from time to time

Unless expressly stated on the platform, membership does not include separately sold standalone products, paid workshops, or the Full REINVENT Worklife pathway.

Future access and products

Some content, resources, or pathways may in future be subject to separate access terms. Where this applies, details will be provided at the point of access and you will not be charged without your prior consent.

Standalone purchases

Some digital products, courses, workshops, programmes, or pathway materials may in future be offered as one-time or separate purchases. Unless otherwise stated at the point of purchase, standalone purchases remain available to the purchasing account for at least 12 months from the date of purchase, subject to platform availability and these Terms.

Standalone purchases are separate from membership unless expressly stated otherwise.

Non-transferable

All access is for individual use only and may not be shared, transferred, sub-licensed, or resold.


Privacy and identity options

This platform supports privacy-first participation. Depending on the features available at the time of use, Users may be able to post using anonymous posting and/or adjust their visible display name, for example using an alias or nickname.

Important: anonymous posting is not a guarantee of complete anonymity. Platform administrators, moderators, and service providers may be able to access certain account-level information for safety, compliance, fraud prevention, or operational reasons.

For your own privacy and the privacy of others, Users should avoid sharing highly identifying details such as full names, private contact details, exact workplaces, addresses, or other information that could identify you or third parties.


User conduct and community rules

Users agree to participate respectfully and to protect the privacy of others. Users agree not to post, share, or publish:

  • Personal or health information about other people, including colleagues, employers, clients, or family members, that could identify them
  • Highly identifying details about themselves, such as full name, address, private contact details, or exact workplace, where it is not necessary
  • Content that is illegal, discriminatory, threatening, pornographic, or that violates third-party rights
  • Unsolicited advertising, spam, or commercial offers
  • Personal information of minors

Prohibited content and conduct

To help keep the community safer and aligned with its peer-support purpose, Users must not post, upload, share, or send content that:

  • Provides professional advice or instructions presented as medical, psychiatric, psychological, nutritional, legal, or financial guidance, e.g. telling someone to start/stop medication, replace professional care, or follow a treatment plan
  • Encourages harm or promotes self-harm, suicide, violence, or illegal activity, including step-by-step instructions
  • Includes graphic detail describing self-harm, suicide, violence, or abuse in a way that may be harmful to other members
  • Identifies third parties or workplaces, including naming employers, colleagues, managers, or clients, or sharing exact workplaces or identifying workplace allegations
  • Doxxes or shares private or confidential information, e.g. addresses, phone numbers, private emails, personal documents, about yourself or others
  • Harasses, threatens, discriminates against, or uses hate speech against any individual or group
  • Spams or self-promotes, including advertising, affiliate links, recruitment, or unsolicited promotional direct messages, unless explicitly approved in writing by WIA Community e.U.
  • Impersonates others or misrepresents identity in a way that misleads, defrauds, or harms other Users
  • Diagnosing, labelling, or speculating about another person’s mental health, personality, motives, medical condition, or private circumstances, including employers, colleagues, managers, family members, partner providers, or other Users
  • Unauthorised copying, reposting, downloading, distributing, or reusing community content, course materials, workshop materials, partner materials, or other copyrighted resources without permission

WIA Community e.U. may remove or restrict content that violates these rules, and may suspend or terminate accounts for serious or repeated breaches.

Confidentiality and sharing outside the platform

We aim to maintain a respectful, thoughtful, and supportive environment through moderation and community guidelines, including privacy expectations, consent-before-advice, and restrictions on harmful, inappropriate, or intrusive content.

Users acknowledge that no online platform can guarantee that other Users will never take screenshots or share content. However, WIA Community e.U. will review reports and take reasonable steps within the platform to protect the community in line with these Terms and the Community Guidelines.


Acceptable use

This Application and the Service may only be used within the scope of what they are provided for, under these Terms and applicable law.

Users are solely responsible for making sure that their use of this Application and/or the Service violates no applicable law, regulations or third-party rights.

Fair-use policy

Access to our services, courses, and community features is provided for reasonable, personal use by the member. To protect service quality for all users, you agree not to:

  • Share, lend, or sell your account credentials, or allow simultaneous access by multiple people
  • Bulk-download, scrape, or systematically copy content, including via bots, crawlers, or automated tools, beyond normal personal use
  • Republish, mirror, or redistribute member-only content outside the platform, except as expressly permitted by WIA Community e.U.
  • Abuse live sessions or community resources, e.g. excessive no-shows, spamming, off-topic promotion, or disruptive behavior
  • Bypass or interfere with technical measures such as rate limits, DRM, or access controls

We may apply reasonable technical limits, (e.g., download caps, session limits, bandwidth throttling, or API/request rate-limiting) to safeguard platform stability. If we detect activity that appears to breach this policy, we may contact you for clarification, temporarily restrict features, or suspend the account pending review. Repeated or serious violations may result in termination under these Terms.

Reporting and moderation

WIA Community e.U. reserves the right to moderate content and remove or restrict material that violates these Terms, the Community Guidelines, applicable law, or platform standards. Moderation may be performed by our team and/or contracted moderators.

Users may report inappropriate, harmful, or sensitive content at any time using the platform’s report tools and/or by contacting support@whereimatcommunity.com. Reports are treated confidentially and reviewed as reasonably practicable.

All user-generated content may be reviewed before or after publication using a combination of automated filters and human review. WIA Community e.U. may edit, restrict, or remove content where reasonably necessary to enforce these Terms, comply with applicable law, protect Users, or maintain the safety and functioning of the platform, including where content:

  • Violates these Terms, applicable law, or third-party rights
  • Contains prohibited content as described in these Terms
  • Is abusive, defamatory, fraudulent, misleading, or otherwise harmful
  • Unreasonably compromises the privacy or safety of Users or third parties

The moderation team may issue warnings, temporarily restrict access, limit posting privileges, or suspend accounts for repeated or severe violations.

Digital Services Act point of contact

In accordance with Articles 11 and 12 of the EU Digital Services Act (Regulation (EU) 2022/2065), WIA Community e.U. provides the following single point of contact for communications with authorities and users regarding content moderation, safety, or other DSA matters:

This address may be used by competent authorities, trusted flaggers, and users for issues under the scope of the Digital Services Act. Communications in English or German are accepted.

Content moderation and appeal rights

Content that violates platform rules or applicable law may be removed or restricted using automated tools or human review, in accordance with the EU Digital Services Act. Users will receive notice of moderation actions affecting their content, with a clear explanation of the reason and impact.

Users may contest moderation decisions by submitting an appeal to support@whereimatcommunity.com. Appeals will be reviewed fairly and as promptly as reasonably practicable, and we aim to respond within 14 business days. Users retain the right to pursue further remedies with competent authorities or courts in Austria.

Safety escalation

This platform is not a crisis service or emergency support provider. If a User indicates they may be at immediate risk of harming themselves or others, or appears unable to cope, WIA Community e.U. and/or moderators may:

  • Direct the User to crisis resources and encourage them to seek qualified support, and/or
  • Take reasonable steps available within the platform, such as limiting content visibility or restricting access, to reduce immediate risk to the community

Moderation and safety actions are taken to protect the community and do not constitute therapy, medical care, or crisis intervention.


Notice and takedown procedure for unlawful content

If you believe that material available on our platform infringes your copyright or other legal rights, or is otherwise unlawful, you may submit a takedown notice to support@whereimatcommunity.com or via the platform’s report mechanism. Your notice must include:

  • Identification of the material claimed to be unlawful or infringing, with a specific URL or description
  • The reason for the complaint (e.g., copyright infringement, defamation, other legal violation)
  • Your name, contact details, and a statement of good-faith belief that use of the material is not authorised
  • A statement that the information in the notice is accurate

Upon receipt, we will:

  • Promptly acknowledge your notice, within 24 hours if possible
  • Review the complaint and temporarily remove or restrict access to the content if the claim is plausible
  • Notify the user who uploaded the content, describing the takedown and the grounds for removal

Counter-notice procedure

If your content has been removed and you believe this is in error, you may file a counter-notice by contacting support@whereimatcommunity.com, providing:

  • Identification of the removed content and its location before removal
  • A statement, in good faith, explaining why the content does not violate law or third-party rights, or that you have rights or authorisation for the material
  • Your name, address, and contact information, and your consent to disclosure of this information to the original complainant as required
  • A statement consenting to jurisdiction in Austrian courts should a dispute arise

Upon receiving a valid counter-notice, we will:

  • Promptly review the response and notify the original complainant
  • Unless prohibited by law or court order, restore the content 10 to 14 business days after notice to the complainant, unless we are informed of legal action to prevent restoration

Record-keeping and transparency

We maintain a record of all takedown and counter-notices, actions taken, and correspondence for compliance and audit purposes, as required under the Digital Services Act. Misuse of this procedure (e.g., false claims or counter-notices made in bad faith) may result in legal liability or termination of platform privileges.

Repeat-infringer policy

We may, in appropriate circumstances and at our sole discretion, disable or terminate the accounts of users who are repeat infringers of intellectual property rights.


Content

Content on this Application

Unless otherwise specified or clearly recognisable, all content available on this Application is owned or provided by the Owner or its licensors.

The Owner undertakes its utmost effort to ensure that the content provided on this Application infringes no applicable legal provisions or third-party rights. However, it may not always be possible to achieve such a result. In such cases, without prejudice to any legal prerogatives of Users to enforce their rights, Users are kindly asked to preferably report related complaints using the contact details provided in this document.

Content provided by Users

The Owner allows Users to upload, share or provide their own content to this Application.

By providing content to this Application, Users confirm that they are legally allowed to do so and that they are not infringing any statutory provisions and/or third-party rights.

Users acknowledge and accept that by providing their own content on this Application they grant the Owner a non-exclusive, worldwide, fully paid-up and royalty-free licence to process, display and distribute such content within the community and related platform features, solely for the operation and maintenance of this Application as contractually required. User-generated content otherwise remains the intellectual property of the respective User.

To the extent permitted by applicable law, Users waive any moral rights in connection with content they provide to this Application.

Users are solely liable for any content they upload, post, share, or provide through this Application.

Users acknowledge and accept that the Owner filters or moderates such content after it has been made available. The Owner therefore reserves the right to refuse, remove, delete, or block such content at its own discretion, and to deny access to this Application to the uploading User without prior notice, if it considers such content to infringe these Terms, any applicable legal provision or third-party right, or to otherwise represent a risk for Users, third parties, the Owner and/or the availability of the Service.

The removal, deletion or blocking of content shall not entitle Users who have provided such content, or who are liable for it, to any claims for compensation, damages or reimbursement.

Users agree to hold the Owner harmless from and against any claim asserted and/or damage suffered due to content they provided to or through this Application.

By posting content, you consent to moderation processing as described in our Privacy Policy. Anonymous posting is available, but administrators and moderators retain access for safety and compliance purposes.

Intellectual property rights

Without prejudice to any more specific provision of these Terms, any intellectual property rights, such as copyrights, trademark rights, patent rights and design rights related to this Application, are the exclusive property of the Owner or its licensors and are subject to the protection granted by applicable laws or international treaties relating to intellectual property.

All trademarks, nominal or figurative, and all other marks, trade names, service marks, word marks, illustrations, images, or logos appearing in connection with this Application are, and remain, the exclusive property of the Owner or its licensors.

All original content produced by WIA Community e.U., including website materials, graphics, and community resources, is owned by WIA Community e.U.


External resources, partners and affiliates

Through this Application, Users may have access to external resources provided by third parties. Users acknowledge and accept that the Owner has no control over such resources and is therefore not responsible for their content and availability.

Conditions applicable to any resources provided by third parties, including those applicable to any possible grant of rights in content, result from each such third party’s terms and conditions or, in the absence of those, applicable statutory law.

The Service may contain links to external websites, tools, services, partner programmes, referral pathways, digital products, or independent experts, facilitators, educators, or providers. WIA Community e.U. is not responsible for the content, availability, privacy practices, services, advice, conduct, or outcomes of external providers.

Where external experts, partner pathways, referral options, workshops, programmes, or third-party services are featured, mentioned, or linked, they act independently. Any separate engagement, booking, purchase, participation, or contract with such a third party is solely between the User and that third party, and is governed by their own terms and policies.

Some links may be affiliate or referral links, which means WIA Community e.U. may receive a commission or referral fee if a User chooses to purchase through them. This does not increase the price payable by the User unless otherwise stated, and does not create responsibility by WIA Community e.U. for the third party’s services or outcomes.

Third-party services and referrals

From time to time, the Service may refer Users to external experts, facilitators, service providers, or partner programmes through REINVENT Partners or other areas of the platform. Any such third parties act independently from WIA Community e.U. and are solely responsible for their own services, advice, conduct, legal compliance, regulatory obligations, terms, and policies.

Any separate engagement, booking, purchase, or contract with a third party is solely between the User and that third party. WIA Community e.U. does not guarantee the availability, suitability, or outcomes of third-party services.

Independence of expert-led content

Where the Service includes guest sessions, expert-led workshops, partner pathway pages, or educational contributions by external experts, such content is provided by independent third parties from their own professional, educational, or lived-experience perspective. Unless expressly stated otherwise, such persons do not act as employees, agents, or representatives of WIA Community e.U. in relation to their separate services.


Terms and conditions of sale

These provisions apply only if and when WIA Community e.U. offers specific paid products, standalone courses, or digital goods for separate purchase. They do not apply to basic platform membership, which is currently free. No payment method is active on this Application at the time of writing.

All notifications related to any purchasing process shall be sent to the email address provided by the User for that purpose.

Prices

Users are informed during the purchasing process, and before order submission, about any fees, taxes and costs that they will be charged. Prices are displayed including all applicable fees, taxes and costs.

Offers and discounts

The Owner may offer discounts or special offers for the purchase of Products. Any such offer or discount is always subject to the eligibility criteria and the terms set out in the corresponding section of this Application, and is granted at the Owner’s sole discretion. Repeated or recurring offers create no claim or right that Users may enforce in the future. Where an offer is limited by time, time indications refer to the time zone of the Owner as stated in this document, unless otherwise specified.

Methods of payment

Information related to accepted payment methods would be made available during the purchasing process. Some payment methods may only be available subject to additional conditions or fees.

All payments are independently processed through third-party services. This Application does not collect any payment information, such as credit card details, and receives only a notification once a payment has been successfully completed. See the Privacy Policy for how payment-related data would be handled.

If a payment fails or is refused by the payment service provider, the Owner is under no obligation to fulfil the purchase order, and reserves the right to claim any related expenses or damages from the User.

Retention of ownership and usage rights

Until payment of the total purchase price is received by the Owner, any Products ordered shall not become the User’s property, and Users do not acquire any rights to use the purchased Product.

Delivery of digital content

Unless otherwise stated, digital content purchased on this Application is delivered via download or platform access on the device or devices chosen by Users. Users acknowledge that in order to download and/or use the Product, the intended devices and their software, including operating systems, must be legal, commonly used, up to date, and consistent with current market standards. The ability to download a purchased Product may be limited in time and space.

Provision of personal data

To access or receive some Products provided via this Application as part of the Service, Users may be required to provide their personal data as indicated on this Application. If the User withdraws consent to the processing of personal data required for the provision of the Service, the Owner reserves the right to terminate the contract with the User.

Right of withdrawal and its limits for digital content

Austrian and EU consumer law generally provides a 14-day right of withdrawal for distance contracts. A statutory exception applies to digital content and digital services where the User requests immediate performance or access, and acknowledges that the right of withdrawal is lost once performance begins.

Where a paid Product is offered, this acknowledgement would be requested and recorded at the point of purchase. For non-digital elements, or where withdrawal rights apply under mandatory law, contact support@whereimatcommunity.com within 14 days.

Legal guarantee of conformity for Digital Products under EU law

Under EU law, for a minimum period of 2 years from delivery, or in the case of Digital Products supplied continuously for more than 2 years for the entire supply period, traders guarantee conformity of the Digital Products they provide to Consumers.

Where Users qualify as European Consumers, the legal guarantee of conformity applies to the Digital Products available on this Application in accordance with the laws of the country of their habitual residence. National laws of that country may grant Users broader rights.

Some Digital Products available on this Application may have characteristics deviating from the objective requirements of conformity, such as their interoperability, compatibility, fitness for purpose, or functionality. Further information is found in the dedicated sections of this Application and would be pointed out during the purchasing process.

Where the Owner provides one or more updates to a purchased Digital Product, the User is required to install or implement all such updates according to the instructions provided by the Owner whenever informed to do so. Failure to install or apply any such updates may result in forfeiture of conformity claims with respect to the Digital Product.


Cancellation, refunds, and your account

Cancellation

As the platform is currently free, billing and refund provisions do not apply to basic access. No charges apply, and there is nothing to cancel in billing terms.

Users may cancel their account at any time via account settings or by contacting support@whereimatcommunity.com. Upon cancellation, access to the platform continues until you choose to delete your account.

Refunds

Where separately purchased standalone products are made available in future, refund terms will be stated at the point of purchase in accordance with Austrian and EU consumer law. Where applicable law provides stronger rights, such as the 14-day withdrawal period for eligible purchases, those legal protections apply and override any policy stated here.

Data and account

Upon account deletion requests, the Owner will remove or anonymise personal data as outlined in the Privacy Policy, subject to any legal retention obligations (e.g. accounting, security, fraud prevention).

Important: if you request full account deletion, you may lose access to member areas because the account record is required to deliver that access. If you wish to reduce personal data while keeping access, you may request data minimisation instead of full deletion by contacting support@whereimatcommunity.com.

Deletion requests are processed within a reasonable timeframe and in line with the Privacy Policy and legal obligations.


Your data protection rights

WIA Community e.U. processes personal data in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG). All users have the following rights regarding their personal data:

  • Right to access and receive a copy of your data

Legal basis: personal data used for service provision, account management, community participation, and moderation is processed under Art. 6(1)(b) GDPR (contract performance) and Art. 6(1)(f) GDPR (legitimate interest).


Peer support, no professional advice, no reliance

The platform provided by WIA Community e.U. is a peer community and self-guided educational offering based on lived experience. WIA Community e.U. does not provide therapy, coaching, counselling, medical or psychiatric services, diagnosis, treatment, or personalised professional advice.

Any content shared by the Owner, guests, or Users is provided for general information and reflection purposes only. You agree not to rely on such content as professional advice. If you need individual support, clinical care, crisis support, or professional guidance, including medical, psychological, legal, HR, or financial guidance, you should consult appropriately qualified professionals in your local area.

If you are in distress, feel unsafe, or need urgent support, please contact local emergency services or an appropriate local crisis support service in your area.

Nothing in these Terms excludes or limits rights or remedies that cannot be excluded under Austrian or EU consumer law.


Liability and indemnification

Indemnification

The User agrees to indemnify and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners and employees harmless from and against any claim or demand, including but not limited to lawyers’ fees and costs, made by any third party due to or in relation with any culpable violation of these Terms, third-party rights or statutory provisions connected to the use of the Service by the User or its affiliates, officers, directors, agents, co-branders, partners and employees, to the extent allowed by applicable law.

Limitation of liability

Unless otherwise explicitly stated, and without prejudice to mandatory law, Users shall have no right to claim damages against the Owner, or any natural or legal person acting on its behalf.

This does not apply to damages to life, health or physical integrity, damages resulting from the breach of material contractual obligations such as any obligation strictly necessary to achieve the purpose of the contract, and/or damages resulting from intent or gross negligence, as long as this Application has been appropriately and correctly used by the User.

Unless damages have been caused by way of intent or gross negligence, or they affect life, health or physical integrity, the Owner shall only be liable to the extent of typical and foreseeable damages at the moment the contract was entered into.

Within the limits stated above, the Owner shall not be liable for:

  • Damages or losses resulting from interruptions or malfunctions of this Application due to acts of force majeure, or unforeseen and unforeseeable events beyond the control of the Owner, such as failures or disruptions of telephone or electrical lines, the internet and/or other means of transmission, unavailability of websites, strikes, natural disasters, viruses and cyber attacks, or interruptions in the delivery of products, third-party services or applications
  • Any loss of business opportunities and any other loss, even indirect, that may be incurred by the User, such as trading losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, or loss of reputation or goodwill
  • Any losses that are not the direct consequence of a breach of the Terms by the Owner

Additional limitation for peer community and User content

To the maximum extent permitted by applicable law, WIA Community e.U. shall not be liable for any loss or damage arising from or in connection with:

  • Any content, statements, resources, recommendations, views, or communications shared by Users or third parties, including within community spaces, comments, messages, live sessions, or linked resources
  • Any decision, action, or outcome resulting from a User’s reliance on content shared within the community or on the platform
  • Interactions, disputes, harassment, or conduct between Users, including communications that occur on or off the platform
  • Any third-party websites, tools, integrations, links, resources, or services, including their availability, accuracy, security, or data practices

The Owner does not screen, verify, endorse, or guarantee the accuracy, completeness, or suitability of User-generated content. Users remain solely responsible for how they interpret and use any information obtained through the platform.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Austrian or EU consumer law. In particular, this limitation does not affect liability for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), injury to life, body or health, mandatory statutory guarantees, or other non-waivable consumer rights under the Austrian Consumer Protection Act (KSchG).


Common provisions

No waiver

The Owner’s failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.

Service interruption

To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates or any other changes, informing Users appropriately.

Within the limits of law, the Owner may also decide to suspend or discontinue the Service altogether. If the Service is discontinued, the Owner will cooperate with Users to enable them to withdraw personal data or information, and will respect Users’ rights relating to continued product use and/or compensation, as provided for by applicable law.

The Service might also be unavailable due to reasons outside the Owner’s reasonable control, such as force majeure events including infrastructural breakdowns or blackouts.

Service reselling

Users may not reproduce, duplicate, copy, sell, resell or exploit any portion of this Application or its Service without the Owner’s express prior written permission, granted either directly or through a legitimate reselling program.

Privacy policy

To learn more about the use of their personal data, Users may refer to the Privacy Policy of this Application.

Assignment of contract

The Owner reserves the right to transfer, assign, dispose of by novation, or subcontract any or all rights or obligations under these Terms, taking the User’s legitimate interests into account. Provisions regarding changes to these Terms apply accordingly.

Users may not assign or transfer their rights or obligations under these Terms in any way, without the written permission of the Owner.

Severability

Should any provision of these Terms be deemed or become invalid or unenforceable under applicable law, the invalidity or unenforceability of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

For EU Users: should any provision be or be deemed void, invalid or unenforceable, the parties shall do their best to find, in an amicable way, an agreement on valid and enforceable provisions substituting the void, invalid or unenforceable parts. In case of failure to do so, the void, invalid or unenforceable provisions shall be replaced by the applicable statutory provisions, if so permitted or stated under the applicable law.

The nullity, invalidity or impossibility to enforce a particular provision of these Terms shall not nullify the entire Agreement, unless the severed provisions are essential to the Agreement, or of such importance that the parties would not have entered into the contract if they had known that the provision would not be valid, or in cases where the remaining provisions would translate into an unacceptable hardship on any of the parties.

Accessibility

The Owner is committed to making the content accessible to Users with disabilities. If Users have a disability and are unable to access any portion of this Application due to their disability, they should give notice including a detailed description of the issue encountered. If the issue is readily identifiable and resolvable in accordance with industry-standard information technology tools and techniques, the Owner commits to promptly address it. Governing law, jurisdiction and disputes

Governing law

These Terms and all related agreements are governed by the laws of the Republic of Austria, being the place where the Owner is based, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

Prevalence of national law

Regardless of the above, if the law of the country the User is located in provides for higher applicable consumer protection standards, those higher standards shall prevail.

Venue of jurisdiction

The exclusive competence to decide on any controversy resulting from or connected to these Terms lies with the courts of the place where the Owner is based. This does not apply to any Users that qualify as European Consumers, nor to Consumers based in the United Kingdom, Switzerland, Norway or Iceland.

Consumer status

Unless otherwise agreed in writing, users act as consumers within the meaning of §1 of the Austrian Consumer Protection Act (KSchG). Business use requires prior written agreement.

Dispute resolution and consumer rights

Complaints can be submitted to support@whereimatcommunity.com and will be reviewed as promptly as reasonably practicable. We aim to respond within 5 business days.

For unresolved consumer disputes, users may contact recognised Austrian or EU dispute resolution bodies. EU-based consumers may also bring claims before the competent courts of their home country, irrespective of any exclusive jurisdiction clause.

Language

These Terms are provided in English only. Statutory Austrian and EU consumer protection rights apply in all cases, regardless of contract language.


Changes to these Terms

The Owner reserves the right to amend or otherwise modify these Terms at any time. Such changes will only affect the relationship with the User from the date communicated to Users onwards.

Where legally required, or where changes are material, Users will be appropriately informed via the platform and, where possible, by email. Continued use of the Service after the effective date of the changes constitutes acceptance of the revised Terms. If Users do not wish to be bound by the changes, they must stop using the Service and may terminate the Agreement.

The applicable previous version will govern the relationship prior to the User’s acceptance. The User can obtain any previous version from the Owner.


Definitions and legal references

This Application The property that enables the provision of the Service.

Agreement Any legally binding or contractual relationship between the Owner and the User, governed by these Terms.

Consumer Any User qualifying as such under applicable law.

Digital Product A Product that consists of content produced and supplied in digital form, and/or a service that allows for the creation, processing, storing or accessing of data in a digital form, or the sharing or any other form of interaction with digital data uploaded or created by the User or any other user of this Application.

European (or Europe) Applies where a User, regardless of nationality, is in the EU.

Owner (or We) The natural person or legal entity that provides this Application and/or the Service to Users.

Product A good or service available through this Application, such as physical goods, digital files, software, or booking services, and any other types of products separately defined here, such as Digital Products.

Service The service provided by this Application as described in these Terms and on this Application.

Terms All provisions applicable to the use of this Application and/or the Service as described in this document, including any other related documents or agreements, and as updated from time to time.

User (or You) Any natural person or legal entity using this Application.
